Upon submitting your event application, waiver, and/or registering for our events, you agree to the following terms.
ASSUMPTION OF THE RISKS OF BAY SWIMMING – Open water swimming is inherently dangerous. There are many health hazards associated with swimming in San Francisco Bay. Marine life, boat traffic, water pollution, fixed objects under water, currents and weather-related phenomena are just some of the causes for concern that open water swimmers may encounter. Injury, hypothermia, heart attack and death are rare but they do occur.
I UNDERSTAND AND ASSUME ALL RISKS ASSOCIATED WITH SWIMMING IN THE BAY.
RELEASE SAN FRANCISCO SWIM, LLC FROM LIABILITY – On behalf of my heirs, assignees, personal representatives, and next of kin, I hereby release and hold harmless San Francisco Swim, LLC, its officers, members, officials, agents, and employees and other participants, with respect to all injury, disability, death, loss, injury, or damage to me or my property, whether arising from the negligence of San Francisco Swim, LLC, its members, officers, or otherwise.
BY SIGNING THIS WAIVER AND RELEASE, I CERTIFY THAT I UNDERSTAND THAT I CANNOT SUE ANY PERSON, INSTRUCTOR, COACH OR THOSE WHO ACT ON BEHALF OF the SAN FRANCISCO SWIM, LLC ORGANIZATION OR THOSE WHO MAY HAVE AUTHORITY OVER THE COMPANY, AND NO ONE ELSE CAN SUE ON MY BEHALF.
AGREE TO THE EXPECTATIONS – When considering my entry into any San Francisco Swim, LLC open water swim, I hereby: 1. agree to comply with all rules, regulations and event instructions of San Francisco Swim, LLC and its Directors; 2. attest and verify that I am physically fit and have sufficiently trained for the particular open water swimming even and that my physical condition is optimal; 3. consent to having my swim event interrupted and/or terminated by any officer or representative of San Francisco Swim, LLC that may consider the continuation of my swim to be unsafe due to injury, accident, illness, prolonged exposure to the water, development of poor weather conditions or any other reason deemed to be unsafe during any San Francisco Swim, LLC event; 4. agree that in the event of a race cancellation due to conditions beyond the control of San Francisco Swim, LLC, including but not limited to a storm, rain, inclement seas or weather, winds, “Acts of God”, “Acts of Terrorism”, or other conditions, my entry fee shall be non-refundable.
Under no circumstances may you sell, trade or allow someone else to take your entry. Such substitutions jeopardize our insurance and our ability to secure the permits necessary to produce future events.
If you cannot participate in an event for which you have registered or wish to attend a different event, you may be eligible to receive a partial rollover credit, which may be applied towards any future San Francisco Swim event. Rollover credits are presented as coupon codes for use towards one event of equal or greater value and are valid for twelve months after they have been offered to the participant. To receive a rollover credit, you must notify us of your intention to pull out of a race no later than 8 days prior to the event date.
If, within the 30 days leading up to the event, a medical reason, military deployment or death in the family will prevent your participation you must notify us in writing and attach documentation (i.e. doctor’s note, deployment notice) to support your claim. In these three cases, you will be eligible for 100% refund. If in the event your medical issue/recovery resolves before race day but your training is deemed inadequate, we will issue a full 100% credit.
If you cannot attend the event to which your rollover credit is being applied, you will only be eligible for one further rollover credits related to that event. However, 65% of the original entry fee paid will be retained by San Francisco, LLC. 35% of the original entry fee paid will be credited to you. This credit is valid until the end of the year in which the event takes place unless otherwise noted and can be used towards any applicable event for which the registration cost is of equal or greater value. rollover credits, once used, cannot be used again.
If the entry fee is under $100 or is for a Monthly Alcatraz, the credit is transferable to another session of the same event on a different date.
Rollover credits are not eligible for transfer from one participant to another.
